Terms & Conditions

Welcome to Scratch Map (the "App"). These Terms and Conditions (the "Terms") are a binding agreement between you and Zafiro Labs SAS ("Zafiro Labs", "we", "us" or "our"), a company incorporated under the laws of the Oriental Republic of Uruguay, and govern your access to and use of the App.

By purchasing, downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

1. Eligibility

You must be legally capable of entering into a binding contract under the laws of your jurisdiction to use the App. If you are a minor, you may use the App only with the consent of a parent or legal guardian who agrees to these Terms on your behalf.

2. License to Use the App

Subject to your compliance with these Terms, Zafiro Labs grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install and use the App on devices you own or control, solely for personal, non-commercial use.

The App is licensed, not sold, to you. We reserve all rights not expressly granted in these Terms.

3. Purchase and Refunds

The App is a one-time paid purchase processed exclusively through the Apple App Store or Google Play and subject to their respective terms and refund policies. There are no subscriptions, no in-app purchases and no advertising.

Refunds. Except where required by mandatory law, refund requests must be directed to Apple or Google as applicable, since they process all payments.

4. Your Data

The countries you mark and your settings are stored only on your device. You own that data and you are responsible for it, including backing it up through your device's backup mechanism. Because we hold no copy, we cannot recover your map if you delete the App or lose your device without a backup.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful, fraudulent or harmful purpose.
• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App, except to the extent expressly permitted by mandatory law.
• Probe, scan, or test the vulnerability of any system or network related to the App, or breach or circumvent any security measures.
• Copy, modify, distribute, sell, lease or create derivative works of the App or any portion of it.
• Use the App's map services in a manner that violates the terms of our map provider.

6. Our Intellectual Property

The App, including all software, designs, trademarks, logos, graphics and other materials, is owned by Zafiro Labs or its licensors and is protected by intellectual property and other laws. Flag imagery and map data are used under license from their respective providers. Nothing in these Terms grants you any right in our intellectual property other than the limited license set out in Section 2.

7. Third-Party Services and App Stores

The App depends on third-party services, including the Apple App Store, Google Play, Mapbox (map rendering) and Google Firebase (analytics and crash reporting). Your use of these services may be subject to their own terms. We are not responsible for the practices or content of third parties.

Apple-specific terms. If you obtain the App from the Apple App Store, you acknowledge that these Terms are between you and Zafiro Labs only, and not with Apple. Apple has no obligation to provide maintenance or support for the App, and is not responsible for any product warranties or claims related to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

8. Termination

You may stop using the App at any time by deleting it from your device. We may terminate this license if you materially breach these Terms. Sections that by their nature should survive termination — including Our Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Disputes and Miscellaneous — will continue to apply.

9. Disclaimers

To the maximum extent permitted by applicable law, the App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.

Maps, borders and flags are provided for personal, decorative purposes. They do not constitute any statement by Zafiro Labs regarding the legal status of any country, territory or boundary.

10. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Zafiro Labs, its directors, officers, employees, agents, suppliers or licensors be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or any loss of data, arising out of or in connection with the App or these Terms, whether based on contract, tort (including negligence), strict liability or any other legal theory.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or in connection with the App or these Terms will not exceed the greater of (a) the amount you paid for the App, or (b) USD 100.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including any mandatory consumer-protection rights you may have under the laws of your country of residence.

11. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Zafiro Labs and its directors, officers, employees and agents from and against any and all claims, damages, liabilities, losses and expenses (including reasonable attorneys' fees) arising out of or in connection with your violation of these Terms or applicable law.

12. Governing Law and Disputes

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of the Oriental Republic of Uruguay, without regard to its conflict-of-laws principles.

You and Zafiro Labs agree that any dispute arising out of or in connection with these Terms will be submitted to the exclusive jurisdiction of the competent courts of the city of Montevideo, Uruguay, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings in your local courts.

13. Changes to These Terms

We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date at the top of this page. Changes take effect on the date indicated. Your continued use of the App after the changes take effect constitutes acceptance of the modified Terms.

14. Miscellaneous

• Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Zafiro Labs regarding the App.
• Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of such right or provision.
• Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization or sale of assets.
• Force majeure. We will not be liable for any failure or delay in performing under these Terms to the extent caused by events beyond our reasonable control.
• Language. These Terms are drafted in English. Any translation is for convenience only; the English version controls in case of inconsistency.
